Background

An occupational therapist can work in Industrialized countries as an Expert Witness to the Courts in litigation cases arising from catastrophic accidents and medical negligence. They write reports for the Courts in such cases to assess the value of a claim for care and occupational therapy needs of the injured party for their entire life. In litigation, the claimant pursues a Claim to obtain compensation from the Insurance Company.

Soon after sustaining life changing injuries, the claimants solicitors, acting for the person pursing a claim (Claimant), look to engage a professional (Case Manager) to manage the rehabilitative process.

Case Manager comes from a variety of professions to include occupational therapy, physiotherapy, speech therapy, nursing, psychology, and social work. So what is the role of case manager in UK?

The role of a case manager in UK has developed over the last 10 years.

A case manager will make an assessment and coordinate the rehabilitation services recommended by experts, to meet the claimant’s needs. Therefore, the case manager works closely with the claimant and the claimant’s family.

They will also liaise with the solicitors representing the Claimant.

The role of the case manager is to facilitate rehabilitation services and manage the care package, which can be for a time limited period or depending on the severity of the claimant’s injuries, it can be for the rest of the Claimant’s life.

The appointment of case manager is agreed by the claimant, the claimants solicitors and the insurance company (Insurer). The case manager is paid by the Insurer.

Opportunity for Occupational Therapist in India

In the UK, there are established case management companies that delivery services to claimants in the litigation process. Where a claimant is not resident in the UK but is from, say India, then local case manager is sought to provide services to the claimant. There are numerous cases of Indian nationals who have required case management services in India and the Occupational Therapist is often asked to provide details of case managers in India for claimants who are pursuing personal injury claims in the UK Courts. To date, this need has been overcome by finding occupational therapy in India to bridge the gap. They require intensive guidance to fulfill the role of case management.

So why is this service required in India?

Case managers from the UK travel regularly to India to provide case management services to Indian clients. However, they have great difficulties.

  • Bridging the cultural gap.
  • Language barrier.
  • Understanding Indian systems, business practices and
    health care provision.

Many Indian nationals travel to the UK on holiday or to study or to work. Someone who suffer Catastrophic Injury in UK may not get leave to remain in the UK after their initial medical management and they have to return to India or they decide they want to return to India because they want support from their family. Where the claimant is repatriated to India, the insurance company require the services of a Case Manager to coordinate the needs of the claimant in India.

The type of injuries claimants may suffer include but is not limited to,
